A police officer in Burnet Texas has been indicted after shooting a driver who ran over his foot on March 27, 2019.
X-rays showed no injuries to the officer’s foot.
Burnet Patrol Sergeant Russell Butler (pictured top, left) was arrested and charged Tuesday with murder and three counts of aggravated assault by a public servant for killing 25-year-old Brandon Michael Jacque.
Butler was also fired Tuesday April 23 for violating the department’s use of force policy, according to Burnet Police Chief Paul Nelson.
Chief Nelson said before being fired, Butler was on paid administrative leave.
It happened on March 27 after Burnet Police received a 911 caller complaining about loud music at around 1:40 a.m.
When officers responded, arriving on-scene, they approached a driver backing up a red car.
Chief Nelson says Butler was giving verbal commands to Jacque to stop, but the vehicle came towards officer Butler, running over his foot.
After the tire ran over his foot, Butler drew his weapon and fired his gun, striking the driver of the red car.
Brandon Michael Jacque was killed.
A female in the passenger seat of the vehicle was not injured.
“At that time, once that was done, [the officer] called for EMS and started medical procedures on that suspect to help save his life,” Chief Nelson explained, adding that Butler being placed on administrative leave was normal procedure.
After the incident, Butler was taken to Seton Highland Lakes Hospital where X-rays taken showed no bones were broken before he was released, according to Fox 7.
According to his indictment, on March 17, Butler, “did then and there, with intent to cause serious bodily injury to an individual, namely, Brandon Jacque, by shooting him with a firearm.”
Before shooting Jacque, Butler had been with the department for three years.
If convicted, Butler faces up to 99 years in prison.
As for Brandon Michael Jacque he leaves behind his parents, grandparents, a daughter, a sister and brother as well as nieces, nephews, aunts, uncles and many friends, according to the DailyTrib.
In 2011, Brandon Jacque graduated from Burnet High School, where he competed in track, baseball and football.
